No. 1 The outlined terms and conditions are a unilateral agreement, not a contract. The purpose of which is for the submission of investment promotion applications, project amendment applications, extension for document submission deadlines for promotion certificate issuance forms,as issued by the service provider via an e-Investment Promotion System that the service provider or the responsible party provides.

No. 2 In order to apply for investment promotion services via the e-Investment Promotion system, the user must provide complete and accurate information on the form as requested by the service provider during the period that the user uses the service through the e-Investment Promotion System. In the event where the service provider requires additional information from the user for benefits related to the service, the user agrees to promptly provide such information to the service provider, or within the due date, as stipulated by the service provider.

No. 3 For the purpose of security and protection of the e-Investment Promotion system and the user’s information, the service provider and other parties, the user agrees to secure his/her password used in accessing the e-Investment Promotion system, and to not disclose such confidential data to an unauthorized party. The user shall not use the e-Investment Promotion system for the benefit of other parties, and will be held liable for any damages incurred by such infringement.

No. 4 In the event where the user becomes aware, or becomes suspicious of any behaviors, circumstances, or information which might affect the security of the user’s password or any passwords used in accessing an e-Investment Promotion system, and of personal passwords belonging to the user, the user must immediately notify the service provider, who will carry out an investigation and take appropriate measures to prevent any damages that might occur in regards to the services provided.

No. 5 In the event the user’s access to the e-Investment Promotion system has been revoked before the end of the expiration period for any reason, the user will still be bound to this agreement’s terms and conditions, as well as any regulations concerning the use of the e-Investment Promotion System.

No. 6 The user does not have the right to, give, sell, transfer or exchange their right of use of the e-Investment Promotion system to another party in any instance.

No. 7 The user is responsible to maintain all documents and supporting evidence from any business conducted via the system, including other documents or supporting evidence related to business conducted via the system and to submit such documents to the service provider within 7 days upon request. All documents and supporting evidence must be kept for a period of 10 years after the date of the business conducted.

No. 8 The user is responsible to keep processed data or acquired data obtained from the system secure from being accessed by or made public to any unauthorized party. Any data that is no longer of use must be erased by the user so that the data cannot be read or used. In the case of infringement and/or damages incurred by such data, the user will be held liable for such infringement and/or damages incurred.

No. 9 The user shall not reproduce, adapt, modify or alter any data in the e-Investment Promotion system to allow another party to benefit from such data in the user’s e-Investment Promotion system. A request must be made in writing to the service provider in the event the user wishes to change specific data such as the name of the company, or type of activity or product.

No. 10 The service provider reserves the right to cease or revoke the e-Investment Promotion System. at any time without prior notice, in the follows cases:
10.1 When the user has knowingly provided false or incomplete information or has withheld any important pieces of information, causing the service provider to deny the provision of services through the e-Investment Promotion System.
10.2 When the user does not provide the service provider with additional information upon request as prescribed in No. 2 paragraph 2.
10.3 When the user violates the agreement, whether intended or by negligence, causing an unauthorized party to become aware of the confidential data which must not be disclosed as prescribed in No. 3.
10.4 When the user conducts an act that violates the agreement, objectives, stipulations, conditions, or regulations concerning the use of e-Investment Promotion System for investment promotion, or which violates compliance of the conditions which are in force during the period for investment promotion applications.
10.5 When the user conducts an act that violates the right of another party. The user agrees that being revoked of electronic services as prescribed in paragraph 1 does not give the user the right to demand compensation or reimbursement for any expenses from the service provider.

No. 11 The user agrees that in the event their conduct has caused damage to another party or to the service provider, the user alone shall be held liable for any and all damages incurred and will not demand that the service provider share in the responsibility of any damages incurred as a result of the user’s conduct. The user’s conduct, as prescribed in paragraph 1, includes the misuse of the e-Investment Promotion system for other purposes and not the submission of electronic data to the service provider.

No. 12 The user cannot demand any compensation from the service provider in the event of force majeure, system malfunctions or any circumstance that is not caused by the service provider, including the user’s computer system, electrical circuit system or communication system malfunctions, causing the service provider to be incapable of providing regular services to the user.

No. 13 The service provider reserves the right to prescribe, amend or change any regulations, procedures, or criteria in order to enhance the services’ efficiency, to monitor the services, or to secure the e-Investment Promotion system without having attained the user’s prior approval. The user agrees to be in full compliance with such regulations, procedures, or criteria that are currently in force on the date the user begins using the e-Investment Promotion system provided by the service provider, and to remain in agreement with additional services enacted at a later date.

No. 14 The user has read and agrees to be in full compliance with the criteria for use of the e-Investment Promotion system and any regulations or procedures related to its use. In the event of conduct that does not comply with such criteria, the user agrees to allow the service provider to proceed in accordance with such criteria and/or any related regulations without conditions. In the case the service provider changes such regulations, procedures or criteria, the user agrees to automatically comply with and be subject to such changed regulations, procedures or criteria.

No. 15 The user agrees that the operation of the e-Investment Promotion system in this agreement aims to facilitate the user. Hence, in the event of any error, delay, defect, or damage, the user will not request compensation or any expenses from the service provider.

No. 16 The user confirms that the information provided in this registration application and in other applications submitted to the service provider is complete and accurate. The user thoroughly understands the agreement in submitting applications via the internet as well as any concerns, and agrees to comply and be subject to every aspect of the agreement in submitting applications.

No. 17 The service provider reserves the right to disclose to the public only the name of the promoted company, the product, and the type of activity, after the project’s investment promotion application has been approved.
